Special ADA Hank Brennan of the Norfolk County DA's office (NCDAO) must know that the jury in Karen Read's first trial unofficially found her not guilty on counts 1 (second degree murder) and 3 (leaving the scene of an accident) right? Rather than dump those two charges and concentrating on count 2 (manslaughter with a bunch of lesser charges related to operating under the influence), Hank seems hell bent on trying to bolster 1 and 3. Silly man. The jury listened to the CW's witness's (defense's 3rd party culprits) and didn't believe them. Instead of switching things up to concentrate on what he may be able to prove he's just diving right into the rank and rampant speculation of the tiny section of social media who seem to despise Karen (mostly because they rabidly hate Aidan Kearny AKA Turtleboy - more on him later).
In a previous article I talked about the NCDAO's ludicrous attempts at arguing consciousness of guilt. Karen wanting an attorney (which is a constitutional right) and/or parking her car in the middle of her parents driveway do not meet this standard, IMO. Currently, Hank Brennan is fishing for communications that may or may not be on Karen's phone between her and her lawyer, David Yanetti, for a 3 day period right after Boston Police officer John O'Keefe died.
Brennan is basing this request on statements made during an Investigation Discover (ID) docuseries that recently aired. ID followed Karen and her team around before and during the first trial. They also interviewed people involved in the Free Karen Reed (FKR) movement (which I hear they didn't use much of) and some on the other side (which it seems they used much of). Brennan wants all of this footage but who knows how much he'll be able to sort through before the start of trial on April 1 if the motion is granted. Which I'm sure it will be as Judge Beverly Canonne seems to just rubber stamp almost all of the prosecution's motions.
Late last week Brennan added 3/4 of Karen's defense team to his list of witnesses. I'm gonna go out on a limb and suggest this is so that he can get the aforementioned footage into trial. The only other way is for someone from ID to introduce it (or from Karen herself who cannot be forced to testify). In order for ID to legitimize this material Hank will have to wrestle with Warner Brothers, who owns ID. I've seen interviews with director Terry Dunn Meurer (who "went from a fly on the wall to a fly in the ointment" according to Read herself) so maybe getting her to testify won't be difficult. However an interview is much different than testimony so I guess we'll see.
The other part of this whole "consciousness of guilt" thing seems to involve Karen's communications with Aidan Kearny, Aidan was the first journalist to really look into the charges against Karen. He's gotten himself into much hot water as he's doggedly sought interviews with the Canton MA royalty that were in the house at 34 Fairview on the night John O'Keefe died. I call them "royalty" because it seems that the Canton Police department (CPD) and the NCDA's office kow tow to them. DA Michael Morrissey appears to be hell bent on protecting him (see the video he released). Hank wants any communication between Karen and Aiden from his phone extractions as well as with all of those he's been charged with witness intimidation against (AKA the 3rd party culprits). For whatever reason Hank seems to believe that Karen is also involved in this "witness intimidation" and that it shows conciousness of guilt. I worry Hank is gonna throw his back out with all of this reaching. Especially since a grand jury refused to indict Karen and Aiden with colluding to intimidate which means that even the low bar of probable cause was not previously met.
Hank's request for a 3 day fishing expedition into Karen's phone data brings to mind Gilligan's Island, although they were only supposed to be on a 3 hour tour. Still, I'm gonna have a rough time not seeing Hank as Bob Denver playing Gilligan, except far less beloved. Hank trying to make fetch happen with Aiden's phone records is reminiscent of the stranded cast of character's hilarious attempts for rescue. Except that a woman's life hangs in the balance and a police officer is dead and after 3 years we're no closer to knowing what happened than we were on Jan 29 2022.
